Lines of Authority

Please note that license class names can vary by state.

  • NIPR does not verify exams prior to allowing submission of an application, however, an exam is required prior to the states approval of the request.

    • Applicant must pass required exams for license types listed in State Offerings section. If applicant fails to take an exam prior to applying for the license, NIPR will accept and defer the application to Puerto Rico for verification and processing.
    • Exams for Puerto Rico are valid for one (1) year. If applicant fails to apply within one (1) from examination date applicant will need to retake the exam.
    • If license expires, the applicant has up to five (5) years from expiration date before needed to retake the exam. As long as the applicant is in CE compliance the applicant will be able to reapply for the same license and lines of authority.
  • Important Definitions and License Requirements:

  • Insurance Producer - in selling, soliciting, and negotiating insurance, the producer shall not act as authorized representative of the insurer.

    • Insurance Producer cannot be appointed. If an Insurance Producer accepts appointments from an insurer, they have to change their license type to the Authorized Representative.
    • Insurance Producer business entity's designated responsible licensed producers must hold an Authorized Person license.
    • Exams and continuing education must be met in Puerto Rico.
  • Authorized Person - is a designated responsible licensed producer. When a business entity obtains an Insurance Producer or Authorized Representative license, all the individuals affiliated to it will be listed as Authorized Persons.

    • Authorized Person must list only one affiliation to a business entity.
    • More than one affiliation is not permitted.
    • Applicant cannot be a business entity.
    • Authorized Person must apply for lines of authority the business entity holds. Applicant does not need to hold the same license type as the business entity.
    • At least one Authorized Person listed as the designated responsible licensed producer (DRLP) must hold ALL lines of authority as the business.
    • At least one Authorized Person listed as the DRLP must also be listed as an owner, partner, officer, or director on the application
    • At least one DRLP that holds all lines must also be an owner, partner, officer, or director.
    • Exams and continuing education must be met in the applicant's resident state.
  • Authorized Representative - is a producer that subscribes a contract with an insurer to sell, solicit, and negotiate insurance on his behalf and can be as employee or as an independent contractor.

    • Authorized Representative cannot be affiliated to a business entity.
    • Applicant must have an active appointment with at least one insurer for the license to be active.
    • Authorized Representative business entity's designated response licensed producers must hold an Authorized Person license.
    • Exams and continuing education must be met in Puerto Rico.
  • Applications for Other lines of authority will defer to state for approval.

  • Emergency Public Adjuster, Emergency Independent Adjuster: License is currently inactive and will be activated during emergencies.

Rules and Regulations

Applicant Can

  • Submit initial license for individuals electronically.
  • Submit major lines of authority.
  • Submit limited lines of authority.
  • Submit surplus lines for individuals.
  • Add lines of authority (amend) to an existing active license.
  • Reinstate/reapply through NIPR's Resident License (RL) Application.
  • Print license electronically.

Business Rules

  • Applicant must be at least eighteen (18) years old or older as determined from the applicant's date of birth.

  • Applicant must not have an active resident license for any other state.

  • There must be no serious RIRS actions or 1033 actions for the applicant. Please contact the state for additional information, if applicable.

  • If license has a status reason of voluntary surrender applicant may use Resident License (RL) Application.

  • Applicant must use Resident License (RL) application after the month past the expiration date to reinstate license up to five (5) years without having to retake any exams as long as they are in CE compliance. If license has expired and is within one (1) month from expiration date applicant must use Resident License Renewal (RLR) application.

  • All amendment applications will be deferred to the state for review.

  • Applicants must have an active appointment with an insurer for the following license classes to become a valid license: Authorized Representative, Attorney-In-Fact, General Agent or Manager. Please be sure to submit application for appointment once the license is approved and is displaying on the Producer Database (PDB). If the license is not displaying on the Producer Database (PDB), the appointment will be declined.

  • Authorized Person

    • Must pass applicable exams
    • May not actively hold or be applying for another license (exception: Attorney-In-Fact license)
    • Must list only one (1) affiliation, more than one (1) will not be allowed
    • Surplus Lines Broker line of authority applicants must actively hold or be applying for Property and Casualty lines at the same time (business affiliation must hold or apply for Surplus Lines Broker license)
    • NOTE: BEFORE applying for Authorized Person license, applicant’s business entity affiliation must meet all business requirements for the following licenses: Insurance Producer, Authorized Representative, Insurance Consultant, General Agent, Independent Adjuster, Public Adjuster, Viatical Settlements Broker, Viatical Settlements Investment Agent, Reinsurance Intermediary Manager, Reinsurance Intermediary Producer. Authorized Person license will be processed with the business license application at the same time.
  • Authorized Person Business Entity Affiliation must:

    • Register the entity with the Puerto Rico Department of State http://estado.pr.gov/en/ or https://prcorpfiling.f1hst.com/
    • Submit to Puerto Rico OCI the Certificate of Authorization to do Business in PR from the Puerto Rico Department of State
    • Designate an individual that resides in Puerto Rico as its contact for auditing and examination purposes. This individual must be able to, upon our request, provide evidence of the company’s insurance transactions in Puerto Rico. Please submit a letter with the name, telephone, fax, mailing address, physical address and email to regulado@ocs.pr.gov.
    • At least one Authorized Person must be listed as a Designated Responsible Licensed Producer (DRLP) on the business application
    • At least one DRLP on the business application that is an Authorized Person must hold all lines of authority as the business license (exception: business licenses with no lines of authority or “None”)
    • At least one DRLP on the business application must be Owner/Partner/Officer/Director (OPOD) of the business
    • At least one OPOD listed as a DRLP must hold all lines requested on the application (exceptions: General Agent, Surplus Lines Broker, Viatical Settlements Broker)
    • Meet other applicable license class specific business requirements
  • Authorized Representative may not be held simultaneously with Insurance Producer or Authorized Person license. Applicant must have an appointment with an insurer for this license to become valid.

  • Consultant applicants are required to submit a $25,000.00 bond. The bond should be in favor of the Commonwealth of Puerto Rico and sent to the Office of the Commissioner of Insurance of Puerto Rico. Application will be deferred to the state for verification. Insurance Consultants license may not be held simultaneously with any license type outside of Producer.

  • General Agent license may not be held simultaneously with Authorized Person or Insurance Producer license. Applicant must have an appointment with an insurer for this license to become valid.

  • Insurance Consultant license may not be held simultaneously with any license type outside of insurance producer.

  • Manager license may not be held simultaneously with Authorized Person or Insurance Producer license. Applicant must have an appointment with an insurer for this license to become valid.

  • Insurance Producer applying for Agricultural, Marine and Transportation, Surety, and/or Vehicle lines of authority (LOAs) must hold Property and Casualty both single, or combined lines within the same class, or be applying for at the same time.

  • Property or Casualty lines must be applied for together.

  • Provisional Authorized Representative applicants may only apply once a year per line of authority. Applications will be deferred to the state for review and verification that the lines of authority requested are tied to an exam record, unless for hardship license.

  • Provisional Authorized Representative and Provisional Producer application fees will be collected by Puerto Rico and not NIPR. The application will pend until the fees are submitted to the state by the applicant. For any questions, please contact Puerto Rico directly. NIPR transaction & processing fees will still apply.

  • Surplus Lines Broker applicants must hold an active Producer or Authorized Representative license to apply and are required to hold a $25,000 bond. The bond must be in favor of the Commonwealth of Puerto Rico and sent to the Office of the Commissioner of Insurance of Puerto Rico. A copy can be submitted after application is completed to regulado@ocs.pr.gov in order to process the license but original bond is required for it to become valid. Bond must be notarized. If notary is outside of Puerto Rico, a copy of the Notary's certificate from the Secretary of State must be provided with bond. Application will be deferred to the state for verification.

  • Variable Life and Variable Annuity applicants must hold active Life line of authority (within the same class) or be applying for Life at the same time.

  • Viatical Settlements Investment Agent applicants must hold active Authorized Representative license with Life and Variable Life and Variable Annuity lines of authority to apply.

  • If applicant answers no to "Are you a US Citizen?" applicant must send proof of U.S. Employment Authorization to Puerto Rico.

  • If applicant responds "yes" to one of the background questions, please submit supporting documents electronically via NIPR's Attachments Warehouse. The documents may also be submitted to the state via mail, email, or fax.
