Rules and Regulations

Applicant Can

Applicant Cannot

  • Submit a late renew through NIPR's Non-Resident Renewal Application.

Business Rules

  • A business entity must renew its certificate of authority on an annual basis. Failure to do so will result in the Bureau of Insurance terminating the insurance producer license after 90 days without an active certificate or charter.

  • Phone and fax numbers provided cannot begin with one (1).

  • Virginia does not license Sole Proprietorships.

  • If one (1) or more lines of authority (LOAs) in the transaction are declined by the gateway then the entire transaction should be declined and not sent to the state.

  • If applicant responds "yes" to one of the background questions please submit supporting documents electronically via NIPR's Attachments Warehouse. The documents may also be submitted to the state via mail, email, or fax.

  • Please allow a minimum of fifteen (15) business days for processing before contacting the Bureau concerning the status of an application. To search for Virginia license numbers please visit the state website.

  • Please note: An application is considered unapproved and closed after thirty (30) calendar days if the applicant does not provide all required documentation. A new application and non-refundable processing fee is required.

  • Designated Licensed Insurance Producer (DRLP) Requirements:
    • Insurance agencies are required to maintain a Designated Licensed insurance producer ("DRLP") responsible for the agency's compliance with insurance laws and regulations. The DRLP:
      • Must be an employee, officer, or director of the agency
        • For Limited Liability Companies and Partnerships, the Bureau will accept members and partners respectively as the DRLP.
    • Business entities are required within 30 calendar days to report the removal of the DRLP and the name of the new DRLP.
    • For standard license applications, DRLP must actively hold at least one of the following:
      • Major Lines of Authority: Life, Health, Property & Casualty, Personal Lines, Variable Contracts, or Title.
      • Limited Lines of Authority: Limited Lines P&C, Limited Lines Life & Health, Motor Vehicle Rental Contract, or Credit.
    • For non-standard Insurance Producer license types, DRLP must hold the equivalent license qualification as follows:
      • Consultants : Virginia Life & Health Consultant License or Property & Casualty Consultant License, or at least one VA (resident or non-resident) active major line of authority.
      • Limited Lines Firm: Virginia Insurance Producer Property & Casualty license. 
      • Limited Lines Firm - Travel Insurance: Virginia Insurance Producer Property & Casualty or Limited Lines Property & Casualty license.
      • Public Adjusters: Virginia Public Adjuster license.
      • Surplus Lines: Virginia Insurance Producer Property & Casualty Insurance producer license.
      • Viatical Settlement Broker: Virginia Viatical Settlement Broker License.
  • License-Specific Requirements:
    • Consultant
      • Applicant is not allowed to renew Property and Casualty Consultant if Life and Health Consultant is already renewed.
      • Applicant is not allowed to renew Life and Health Consultant if Property and Casualty Consultant is already renewed
    • Managing General Agent:
      • The name and title of all members of a partnership, limited partnership, limited liability company or corporation, and any officers, directors, or employees designated to act as a managing general agent under the license pursuant to § 38.2-1359 of the Code of Virginia.
      • A current biographical affidavit of each person required to be listed in the application.
      • A copy of the contract for all insurers for which the agreement has been executed or amended since the last renewal.
    • Surplus Lines Broker
      • ​​​​​​​Applicant must actively hold a Surplus Lines license in resident state
    • Viatical Settlement Brokers:
      • A Broker (VSB) must first obtain a written agreement from the Viator before performing and services or obtaining any compensation from the Viator.

      • Effective July 1, 2023, a broker (VSB) will affirm when submitting an initial or renewal application that they will or have implemented and operated antifraud initiatives reasonably calculated to detect, prosecute, and prevent fraudulent viatical settlement acts (or life settlement acts) in compliance with § 38.2-6011.E of the Code of Virginia from the effective date of initial licensure as a viatical settlement broker (or life settlement broker) in Virginia and further certify that they will maintain the operation of these antifraud initiatives while they continue to be licensed as a Virginia viatical settlement broker (of life settlement broker). Brokers (VSB) are not required to provide an updated copy of the antifraud plan to the Commission unless requested. This replaces the form filing requirement and the annual March 1 filing.
