Business Rules

  • Rights and Responsibilities:
    • Applicants must apply for the License Classes and Lines of Authorities they qualify for. If you apply for a License Class or for Lines of Authority that you do not qualify, the Department is unable to refund your fees. ARS 20-167.
    • Applicant may not be a sole proprietor.
  • P.O. Box or PMB (Private Mailbox) cannot be used for business address.

  • All instances of phone number must be a valid 10 digit phone number (extensions are allowed).

  • All applications for Variable Life and Variable Annuity line of authority (LOA) must already have an active AZ Life LOA on the Producer Database (PDB) or be applying for a Life LOA at the same time.

  • Surplus Lines Broker applicants must actively hold on PDB in Arizona Insurance Produce license class with Property and/or Casualty LOAs.

  • Exactly one Designated Responsible Licensed Producer (DRLP) must be provided on application. The DRLP entered must have an active equivalent Arizona license class on PDB (resident or non-resident) for the license class supplied in the transaction. DRLP is not required for the below LOAs:
    • Car Rental (PDB: 942)
    • Title Agent (PDB: 1242)
    • Portable Electronics Vendor (PDB: 10395)
    • Self Service Storage Agent  (PDB: 11980)
    • Life Settlement Broker (PDB Code 552)
       
  • Business Entity applicants who have no active AZ license record on PDB must enter at least one 'Individual' entity type on the Owners, Officers, Partners and Directors (OPOD) section of the application. This is not required for the following LOAs:
    • Portable Electronics Vendor
    • Car Rental
    • Self Service Storage Agent 
    • Travel Surplus Lines Broker
    • Life Settlement Broker
       
  • Changes to Owners, Partners, Officers and/or Directors (OPOD) cannot be updated through this process. If you need to update the OPOD's please submit form L-177 which is available on our website https://insurance.az.gov/producers/licensing-related-forms

  • Life Settlement Brokers must hold an active 'Producer, Life' line of authority on PDB or be applying for an underlying Life LOA at the same time as the Life Settlement Brokers LOA.

  • If applicant responds "yes" to one of the background questions please submit supporting documents electronically via NIPR's Attachments Warehouse. The documents may also be submitted to the state via mail, or email.

  • Consider the following facts before applying for an Arizona insurance license:
    • Not everyone qualifies for an insurance license. If applicant has surrendered an Arizona insurance license they may not apply for an Arizona insurance license for one (1) year. If license surrendered was a line of license authority from an insurance license, applicant may not apply for the same license authority for a year. ARS § 20–289(F).
    • Arizona can deny a license for any cause listed in Arizona Revised Statutes ("ARS") § 20–295. Review this statute before deciding to spend the time, effort and money to apply for a license. Truthfully and completely answer questions asked on the application, and it may be necessary to provide additional documentation.
    • Except for confidential pieces of information such as applicant's birth date and social security number, application and documentation will be a matter of public record, which means that any member of the public can view or obtain a photocopy of the information.
  • License Application Steps:
    • Complete the NIPR's ERL Application. After completion, the system may say that the application is "administratively deficient" and will identify additional requirements.
    • If you answer yes to one (1) or more of the background questions, select the "Background Questions Supporting Documents" option for the NIPR Attachments Warehouse to submit:
      • A signed statement describing (in detail) all incidents including (i) names of all involved, (ii) dates and locations, (iii) the names and localities of any courts and/or administrative agencies involved, (iv) the disposition of each matter, (v) whether the conviction, plea or finding was for a felony, misdemeanor or open-ended charge.
      • Documents showing charges and case disposition, including all indictments, complaints, plea agreements, orders of conviction, judgments, notices of hearing or trial, sentencing orders, suspension/revocation orders and other information, that relates to each matter.
      • "Short Form Application for Written Consent to Engage in the Business of Insurance Pursuant to 18 USC §§ 1033 and 1034" if (and only if) convicted of a felony involving dishonesty or a breach of trust, or convicted of violating 18 USC § 1033.   • Additional Requirements for Certain Types of Licenses:
    • For a bail bond agent license, submit the original of a surety bond executed by the surety insurer on Form L­195. Visit the Producers page of the Arizona Department of Insurance website for Form L­195 and additional information about becoming a bail bond agent.
    • For a surplus lines broker license, applicant must hold or be applying for an Arizona-resident property or casualty line of authority.
      • At least one (1) individual in each office location must be licensed as a property or casualty insurance professional and as a surplus lines broker.
    • An Arizona-licensed insurance professional must report changes of address, email addresses, name changes, or changes to a business entity's principals (officers, members, directors, designated responsible producer, etc.) within thirty (30) days. ARS § 20­286(C).
      • Report administrative actions within thirty (30) days after the final disposition of the case. ARS § 20­301(A).
      • Report criminal prosecutions within thirty (30) days after the pretrial hearing, indictment or judgment, whichever is first. ARS § 20­301(B).
      • Renew the license prior to its expiration. Whether the Department of Insurance, as a courtesy, notifies a licensee of upcoming license expiration, the licensee is solely responsible for fulfilling all license renewal requirements prior to the license expiration.
      • Maintain and apply up-to-date knowledge. Use the Arizona Department of Insurance website as a resource for Arizona laws, rules, regulatory bulletins, and other important information.
