Massachusetts Business Entity Requirement
Massachusetts Business Entity Initial Applicants: Please be advised that the Massachusetts statute requires all business entities, resident and nonresident to submit name approval prior to your application being processed. You will submit your documents to MA Department of Insurance.
THREE REQUIRED STEPS TO LICENSING
STEP 1: NAME APPROVAL
- Select your type of Business Entity.
- Download and complete any required documentation.
- Submit completed documents to MA Department of Insurance
STEP 2: FILE WITH THE MA SECRETARY OF STATE
- File with the MA Secretary of State on the Corporate Division’s website at http://www.sec.state.ma.us/cor/Functionality/walkinmail.htm
STEP 3: SUBMIT APPLICATION THROUGH NIPR
- Go to NIPR.com
- Click on Go the Online Application and follow the instructions to submit your application.
- Fees shown are state fees only. These fees do not include NIPR transaction fees.
- All fees are per member.

Applicant Can

Business Rules

Applicant cannot enter DBA name.
- Before a business entity (all types) can apply for licensure, they first must submit specific documentation, based upon their type of business, to the state for name approval.

Surplus Lines Broker applicants must actively hold both Producer Property and Casualty lines of authority.

Personal Lines applicants must hold a Producer/Travel or Property and Casualty license or a Limited Lines Property and Casualty license in the resident state.
- Variable applicants must supply FINRA Central Registry Depository (CRD) number on the application. If you need to verify your CRD number you may use the Broker Search feature found on FINRA’s website.
- Applicant must currently hold or be applying for Life if they are applying for Variable.
- DRLP and Member Rules:
- Designated Responsible Licensed Producers must have an active resident license on the producer database (does not have to be in Massachusetts).
- Designated Responsible Licensed Producers and Members must be actively licensed in the state on the producer database (resident or non-resident of Massachusetts).
- Designated Responsible Licensed Producers provided on the business entity application must also be listed as members (affiliations). There may also be additional members listed outside of the designated responsible producers.
- The members (affiliations) provided must cumulatively cover the lines of authority on the application.
- At least one (1) member, owner, partner, officer or director must be listed on the application.

If applicant responds "yes" to one of the background questions please submit supporting documents electronically via NIPR's Attachments Warehouse. The documents may also be submitted to the state via mail, email, or fax. All other required documentation must be forwarded directly to the state.

Frequently Asked Questions
Online printing information can be found by going to NIPR's license print page and selecting the state.
A licensee must place their termination letter in writing to the Division of Insurance, Producer Licensing Department’s attention. In the letter, they must stipulate what they would like to have happen to their licenses. We prefer that their licenses are also included with the letters.

It depends whether one is moving into the state or whether one is moving out of state. A licensee would have to notify the Division of Insurance’s Producer Licensing Department in writing or may call the Department for further instructions at (617- 521-7794 and opt for line #3).
- If one is moving into MA, he/she has 90 days to make the changes without having to take the MA exams, of course they would have to terminate their old resident license first. MA verifies prior licensure via PDB.
- If one is moving out of MA, we would need that info in writing and the license would be terminated, as the licensee has now moved out of state. If the licensee becomes licensed in new state and wants to remain licensed as a non-resident in MA; he/she must notify the Producer Licensing Dept as soon as they hold a new resident license in his/her new resident state. If there was time left on their MA license which now has a status of moved from state; MA will reactivate license and change to non-resident license.

- A copy of your marriage license
- A copy of your driver’s license, displaying your new name
- A copy of your Divorce Decree
